
The Ministry of Business and Made in Italy (MIMIT) has recently provided the first operational indications regarding the obligation for company directors to provide themselves with an address of Certified Electronic Mail (PEC) and to communicate it promptly to the Company Register.
As clarified by the Ministry, the obligation concerns all administrators – whether they are joint-stock companies, partnerships or cooperatives – and has the objective of simplify and make official communications more transparent, promoting greater efficiency in the dialogue between Public Administration and businesses.
Among the main operational indications that emerged:

The PEC must be uniquely attributable to the administrator, therefore it cannot be shared with other subjects or referred generically to the company.

The PEC address must be active, functioning and consulted regularly.

In case of failure to communicate or invalid address, penalties are foreseen administrative sanctions and the possible suspension of registration in the Company Register.
This obligation represents an important step towards the digitization of institutional communications and requires immediate attention from all involved.
